1. Introduction and Acceptance
These Terms and Conditions (“Terms”) govern your access to and use of the Ticksy website, mobile application, and related services (together, the “Platform”), operated by Ticksy Ticketing (“Ticksy”, “we”, “us”, “our”).
By accessing the Platform, creating an account, or purchasing a ticket through Ticksy, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree to these Terms, you must not use the Platform.
You must be at least 18 years old, or have the consent of a parent or guardian, to create an account or make a purchase on Ticksy.
2. Definitions
- “Event” means any concert, festival, conference, sporting event, or other live event listed for sale on the Platform.
- “Organiser” means the promoter, venue, artist, or entity responsible for producing and delivering an Event.
- “Ticket” means a right of admission to an Event, whether issued as a physical or digital (e-ticket/mobile/wallet) ticket.
- “User”, “you” means any person who accesses or uses the Platform, including to browse, purchase, or resell tickets.
- “Booking Fee” means any service, handling, or transaction fee charged by Ticksy in addition to the face value of a Ticket.
3. Ticksy’s Role as a Platform
Ticksy operates as a ticketing platform and, in most cases, acts as an agent for the Organiser in facilitating the sale of Tickets. The contract for the supply of entry to an Event is between you and the Organiser, unless otherwise stated at checkout for a specific Event.
Ticksy is not responsible for the conduct, content, quality, or delivery of an Event itself. Organisers are responsible for the staging, safety, and delivery of their Events, and for compliance with any applicable licensing, safety, or venue requirements.
Where Ticksy sells Tickets on its own account (rather than as agent), this will be made clear at the point of sale, and Ticksy will accordingly take on the associated seller obligations under the Australian Consumer Law (ACL).
4. Account Registration
To purchase Tickets, you may be required to create a Ticksy account. You agree to provide accurate, current, and complete information, and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.
Ticksy may suspend or terminate an account where we reasonably suspect fraud, breach of these Terms, or conduct that risks the security or integrity of the Platform.
5. Purchasing Tickets
Ticket prices are set by the Organiser and displayed in Australian dollars (AUD) inclusive of GST where applicable, plus any applicable Booking Fee, which will be disclosed prior to checkout.
Tickets are subject to availability. Ticksy does not guarantee that any Event, seating category, or price will remain available until checkout is completed, and a sale is only confirmed once payment has been processed and a confirmation is issued.
You are responsible for checking Event details (including date, time, venue, and age restrictions) before purchasing, as most Ticket sales are final other than as set out in our Refund Policy and under the ACL consumer guarantees described in clause 9.
Ticksy uses reasonable measures to prevent bulk or automated (“bot”) purchasing. We may cancel orders that we reasonably believe were placed using automated means, in breach of any per-transaction purchase limits displayed for an Event.
6. Ticket Resale and Transfer
Some states and territories in Australia regulate the resale of tickets to certain events, including caps on resale price. Where applicable law imposes a resale price cap, you must not resell a Ticket for more than that cap (typically no more than 10% above the original purchase price, though thresholds and exceptions vary):
- New South Wales — Fair Trading Act 1987 (NSW), ticket resale provisions
- Victoria — Major Events Act 2009 (Vic)
- South Australia — Fair Trading (Ticket Scalping) Amendment Act 2014 (SA)
- Queensland — Major Sports Facilities Act 2001 (Qld) (declared events)
- Western Australia — Ticket scalping provisions under WA fair trading law (declared events)
Where Ticksy provides an official resale or transfer facility for an Event, that facility must be used in accordance with any resale cap and any Organiser-imposed restrictions on transfer. Reselling Tickets through unofficial channels, or above any applicable cap, may render the Ticket invalid and may expose you to penalties under state or territory law. Ticksy is not liable for losses arising from tickets purchased through unofficial resale channels.
7. Event Changes, Postponement and Cancellation
Organisers may reschedule, relocate, or cancel an Event. Where this occurs:
- If an Event is cancelled, you are entitled to a refund of the Ticket price and Booking Fee in accordance with our Refund Policy and the ACL.
- If an Event is rescheduled, your Ticket will generally remain valid for the new date, and refund rights will apply where you are unable to attend, as set out in our Refund Policy.
- Minor changes (such as support act changes, venue configuration, or set time changes) do not generally entitle you to a refund.

8. Prohibited Conduct
When using the Platform, you must not:
- Use bots, scripts, or other automated means to purchase Tickets beyond stated limits
- Provide false, misleading, or fraudulent information, including for the purpose of evading purchase limits
- Resell or advertise Tickets in breach of clause 6 or any Organiser resale restrictions
- Use the Platform for any unlawful purpose, or in a way that infringes the rights of Ticksy, an Organiser, or any third party
- Attempt to interfere with, disrupt, or gain unauthorised access to the Platform or its underlying systems
Ticksy may cancel Tickets, suspend accounts, and/or refer matters to relevant authorities where we reasonably believe this clause has been breached.
9. Consumer Guarantees under Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded.
Where permitted by law, our liability for a breach of a non-excludable guarantee is limited, at our option, to resupplying the relevant service or paying the cost of having the service resupplied.

10. Intellectual Property
All content on the Platform, including the Ticksy name, logo, design, text, graphics, and software, is owned by or licensed to Ticksy and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from Platform content without our prior written consent.
11. Privacy
Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which forms part of these Terms and reflects our obligations under the Privacy Act 1988 (Cth) as amended by the Privacy and Other Legislation Amendment Act 2024.
12. Limitation of Liability
To the maximum extent permitted by law, and subject to clause 9, Ticksy’s total liability arising out of or in connection with your use of the Platform (whether in contract, tort, or otherwise) is limited to the amount of the relevant Booking Fee paid by you.
Ticksy is not liable for any indirect, consequential, or special loss, including loss of enjoyment, travel or accommodation costs, or loss of opportunity, arising from an Event being cancelled, rescheduled, or changed.
Ticksy is not responsible for the acts or omissions of Organisers, venues, or other third parties, including the conduct or safety of an Event itself.
13. Indemnity
You agree to indemnify Ticksy against any loss, damage, cost, or expense we incur as a result of your breach of these Terms, your misuse of the Platform, or your violation of any applicable law, including ticket resale laws.
14. Force Majeure
Ticksy is not liable for any failure or delay in performing its obligations where this is caused by circumstances beyond its reasonable control, including natural disasters, extreme weather, pandemic, government action, industrial action, or failure of third-party systems.
15. Dispute Resolution
If you have a complaint, please contact us first at the details in clause 18 so we can attempt to resolve it. If a dispute cannot be resolved directly, either party may refer the matter to the applicable state or territory consumer affairs body (such as NSW Fair Trading) or the relevant civil and administrative tribunal (such as NCAT), or pursue any other right available at law.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services or legal obligations. Updated Terms will be posted on the Platform with a revised “Last updated” date, and material changes will be notified where required by law. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
